Eligibility Criteria for Student Visa Extension in the UK
To apply for a student visa extension within the UK, applicants must adhere to specific guidelines as outlined in the Immigration Rules. The key eligibility requirements include:
To qualify for a student visa extension within the UK, you must adhere to the following key requirements outlined by the Immigration Rules:
- The applicant must already be present in the UK with leave to enter or remain as a student.
- A valid application for a student visa extension should be submitted.
- The extension application must be lodged no earlier than 3 months before the course start date, as specified on the Confirmation of Acceptance for Studies (CAS).
- The course’s start date should fall within 28 days of the applicant’s previous visa expiration.
- All requirements related to the CAS must be fulfilled.
- The applicant must meet all academic requirements for their intended course of study.
- Academic progression must be demonstrated.
- The applicant must score 70 points based on the points-based criteria for the student visa extension.
- The individual must pass the student visa genuineness test.
- The application must not be subject to refusal under the general grounds for refusal set forth in Part 9 of the Immigration Rules.
- The applicant should not be in breach of UK immigration laws; however, any period of overstaying may be overlooked if paragraph 39E applies.
Valid Confirmation Of Acceptance For Studies (CAS)
To ensure the successful extension of a student visa application, it is crucial that the student’s Confirmation of Acceptance for Studies (CAS) remains valid. As per Immigration Rules, students must meet specific criteria for the CAS to be deemed valid. Here’s a comprehensive breakdown of these requirements:
- Validity of the CAS Issuer: The CAS must be issued by a student sponsor whose license remains valid on the decision date of the application.
- Issuance Timing: The CAS must be issued no more than six months prior to the application date.
- Previous Use: The CAS must not have been used in any prior application, whether granted or refused. However, it may have been used in a previous application if that application was rejected as invalid, made void, or withdrawn.
- Offer Withdrawal: The student sponsor must not have retracted the offer to the applicant after the CAS was issued.
- Information Requirements: The CAS must contain comprehensive details to confirm that all the following criteria are satisfied:
- Course requirement
- Approved qualification requirement
- Level of study requirement
- Place of study requirement
- Financial Details: The CAS must specify accommodation costs and fees, including any payments already made, to facilitate the assessment of financial requirements.
- English Language Proficiency: The CAS must demonstrate how the English language requirement has been met. If the sponsor has evaluated the applicant’s language proficiency, the CAS should include details as specified in ST 13.3 and ST 13.4.
- Aden & Co Solicitors outlines the mandatory details that must be provided by a student sponsor when issuing a Confirmation of Acceptance for Studies (CAS). The information must include:
-
- Course title and academic level
- Start and end dates of the course
- Weekly study hours, specifying whether the course is part-time or full-time
- Address of the main study location
- Accommodation and tuition fees
- Details of any references used in the student sponsor’s assessment, if applicable
- Information on any work placements associated with the course
- If a partner institution is involved, the education provider’s details
- If relevant, compliance with the ATAS requirement as outlined in Annex ATAS
- Confirmation of whether the course is a recognised Foundation Programme for postgraduate doctors or dentists, along with a certificate from the Postgraduate Dean if required
- Assessment of the student’s English language proficiency, including test scores for reading, writing, speaking, and listening
- If part of a study abroad programme, the name and address of the partner institution
- If applying for a Student Union Sabbatical Officer role, confirmation of sponsorship for a full-time, paid, executive position either during studies or the academic year following graduation
- For the Doctorate Extension Scheme, confirmation that the CAS was issued within 60 days of the expected PhD course completion, and that the applicant is sponsored by a compliant higher education provider
- For students with prior permission, confirmation that the new course meets academic progress requirements as stipulated in ST 14.1 to ST 14.5.
To successfully apply for a UK Student Visa, applicants must meet specific criteria related to their course of study. Below are the essential requirements:
Single Course Requirement:
The application should be for a single course of study that meets the stipulations under ST 8.2, except in cases such as:
-
- A combined pre-sessional course compliant with ST 15.1 to 15.3.
- A full-time, salaried, elected executive role as a Student Union Sabbatical Officer, either during the applicant’s studies or in the academic year immediately following graduation.
- To enable continuation in the UK under the Doctorate Extension Scheme, where the Confirmation of Acceptance for Studies (CAS) is issued by a higher education provider with a record of compliance, within 60 days of the expected completion of a PhD.
Approved Courses:
The course applied for must fall under one of the following categories:
-
- A full-time course at degree level or higher that leads to an approved qualification.
- A full-time course below degree level, requiring at least 15 hours per week of structured daytime study (08:00 to 18:00, Monday to Friday) that leads to an approved qualification.
- A full-time pre-sessional course with a minimum of 15 hours of daytime study per week.
- A part-time course at a level above a degree, leading to an approved qualification, where CAS is issued by a higher education provider with a proven compliance track record.
- A full-time course at degree level or above that is recognized by UK NARIC as equivalent to a UK higher education course, with the CAS issued by an overseas institution or a compliant higher education provider.
ACCA Qualifications:
If the course involves an ACCA qualification or ACCA Foundations in Accountancy, the student sponsor must be an ACCA-approved learning partner at either Gold or Platinum level.
ATAS Certificate:
If the course requires approval under the Academic Technology Approval Scheme (ATAS), the applicant must provide a valid ATAS certificate along with their Student Visa application.
Approved Qualification Requirements
For any course of study (excluding pre-sessional courses) to meet the approved qualification requirement, it must result in one of the following recognized qualifications:
- Validated by Royal Charter, or
- Granted by a UK-recognised body, or
- Supported by a formal agreement between a UK-recognised body and another education provider or awarding body. This agreement should affirm:
- The UK-recognised body has independently evaluated the student sponsor’s or awarding body’s programme in comparison to the Regulated Qualifications Framework (RQF) or an equivalent framework.
- The UK-recognised body would accept students who successfully complete the provider’s specified course onto one of its degree-level programmes.
- Recognized through a formal articulation agreement between recognised bodies and the awarding institution, or
- In England, Wales, and Northern Ireland: the qualification is at Regulated Qualifications Framework (RQF) level 3 or higher, or in Scotland, accredited at Scottish Credit and Qualifications Framework (SCQF) level 6 or higher, or
- An international qualification that is assessed by UK NARIC as equivalent to RQF level 3 or above, or
- An aviation-related licence, rating, or certificate issued by the UK Civil Aviation Authority.
Study Level Requirements for International Students
When applying for a course with a Confirmation of Acceptance for Studies (CAS) issued by a probationary sponsor, the program must meet specific criteria depending on the applicant’s age and the location of study:
Courses in England, Wales, or Northern Ireland:
- Applicants under 18 must be enrolled in a course at Regulated Qualifications Framework (RQF) Level 3 or higher.
- Applicants 18 or older must be enrolled in a course at RQF Level 4 or above.
Courses in Scotland:
- For those under 18, the course must be at Scottish Credit and Qualifications Framework (SCQF) Level 6 or above.
- Applicants aged 18 and above must be enrolled in a course at SCQF Level 7 or higher.
For courses sponsored by a student sponsor, the following conditions apply:
- In England, Wales, or Northern Ireland, the course must be at RQF Level 3 or higher.
- In Scotland, the course must meet SCQF Level 6 or higher.
- If the applicant is enrolled in a short-term study abroad program in the UK as part of an overseas qualification, the qualification must be at a UK bachelor’s degree level or higher, as recognized by UK NARIC.
- English language pre-sessional courses must meet Level B2 or higher on the Common European Framework of Reference for Languages (CEFR).
- Foundation programmes for postgraduate doctors or dentists are acceptable.
- Courses offered in collaboration between a university and a research institute must be accredited at RQF Level 7 or SCQF Level 11 or above.
Academic Progression Requirement for Student Visa Extension
Applicants seeking an extension of their Student visa must demonstrate academic progression from their previous course unless they qualify under the exceptions outlined in ST 14.4. To qualify, applicants must have successfully completed their previous course or be advancing to a higher-level programme as specified in ST 14.3(a) or (b).
Academic progression can be demonstrated in the following scenarios:
- Advancing from a bachelor’s to a master’s level within an integrated master’s programme, provided the student sponsor has assessed the applicant’s academic ability and offered a place in the higher-level course.
- Progressing from a master’s to a PhD as part of an integrated master’s and PhD programme, again based on the student sponsor’s academic assessment and course offer.
- Enrolling in a course that is above the level of the previous study, unless:
- The student sponsor is a higher education provider with a strong compliance record.
- The course is at degree level or above.
- The new course is at the same level as the previous one, and the student sponsor confirms:
- The new course is either related to or a deeper specialisation of the previous study, or
- The combination of both courses supports the applicant’s genuine career goals.
Applicants are not required to demonstrate academic progress in the following situations:
- They are applying to re-sit exams or retake modules as outlined under ST 14.5, or if they have previously done so and are now seeking to complete the course for which the exams or modules were re-taken.
- They wish to continue their studies with their current student sponsor to complete a PhD or another doctoral qualification that was part of their previous permission period as a student.
- They are switching to a new student sponsor to finish a course that was initiated with a sponsor whose licence was subsequently revoked.
- They are applying to serve as a Student Union Sabbatical Officer.
- They have completed a term as a Student Union Sabbatical Officer and are applying to finish the qualification for which their Confirmation of Acceptance for Studies was issued before their sabbatical period.
- They are applying under the Doctorate Extension Scheme, or as a postgraduate doctor or dentist on a recognised Foundation Programme.
- They are pursuing an intercalated bachelor’s or master’s degree, or a PhD, while studying medicine, veterinary science, or dentistry, or they are seeking to resume their principal course after an intercalation period.
- They are applying for a study abroad programme or work placement that is integral to and assessed as part of their course, or they are completing their course after such a programme or placement.
It is important to note that if an applicant is re-sitting an exam or retaking a module, they must not have done so more than twice unless their sponsor is a fully licensed student sponsor (not a probationary one).
Study Location Requirement
All academic study for the course must be conducted at the premises of the student sponsor or an affiliated institution, unless the student is undertaking a work placement related to their course, participating in a study abroad programme, or enrolled in a pre-sessional course.
Financial Eligibility
Applicants seeking to extend their student visa within the UK, who have legally resided in the country for at least 12 months at the time of application, automatically meet the financial eligibility requirements without needing to demonstrate funds.
Similarly, those applying as a Student Union Sabbatical Officer or for a recognised foundation programme as a medical or dental trainee in the UK are exempt from providing proof of funds. For expert advice on meeting these criteria, consult Aden & Co Solicitors, who specialise in student immigration matters.
When applying for a student visa extension within the UK, and if the applicant has been in the UK for less than 12 months, they must meet specific financial requirements depending on their location of study:
(a) Studying in London
| Type of Study | Funds Required |
|
Residential Independent Schools |
Applicants must have sufficient funds to cover any outstanding tuition and boarding fees for one academic year. |
|
• All other cases |
The applicant must have enough funds to cover any unpaid course fees as listed on their Confirmation of Acceptance for Studies (CAS) and an additional £1,334 for each month of study, up to a maximum of nine months. |
(b) Studying outside London
| Type of Study | Funds Required |
|
Residential Independent Schools |
Applicants must demonstrate sufficient funds to pay any outstanding fees for one academic year, including course and boarding fees. |
|
All other cases |
The applicant must have enough funds to cover unpaid course fees stated on their CAS, plus £1,023 for each month of the course, up to a maximum of nine months. |
- For courses that extend beyond a full month, the financial requirement will be rounded to the next complete month.
- If a deposit has been made for accommodation provided by the student sponsor, up to £1,334 of this amount can be deducted from the total funds required.
- Additionally, if course fees have already been paid, they must be reflected in the CAS or evidenced through a receipt from the student sponsor.
- Applicants, unless supported by a student loan or government/international sponsorship, must prove they’ve held the necessary funds for at least 28 days, as per Appendix Finance (FIN 7.1 to FIN 7.3).
- Applicants must also meet the financial criteria outlined in Appendix Finance, unless exempt under ST 22.1.
English Language Proficiency Requirement
To fulfill the English language requirement, applicants must demonstrate proficiency across all four key areas—reading, writing, speaking, and listening—based on the Common European Framework of Reference for Languages (CEFR). The minimum proficiency levels are as follows:
- Level B2: For those enrolled in a course equivalent to a UK bachelor’s degree or higher.
- Level B1: For applicants taking a pre-sessional course or a course below the UK bachelor’s degree level.
Applicants must adhere to the English language criteria outlined in Appendix English Language.
- If the student sponsor has determined that the applicant meets the English language requirement, this must be clearly stated on the Confirmation of Acceptance for Studies (CAS), along with the method of assessment.
- In cases where a Secure English Language Test (SELT) is mandated, the CAS must include the name of the test provider, the unique reference number, and the scores for each component tested (reading, writing, listening, and speaking).
Combined Pre-sessional Course Requirements
A higher education provider with a proven compliance history can issue a single Confirmation of Acceptance for Studies (CAS) for both a combined pre-sessional course and a degree-level or higher main course if:
- The pre-sessional course duration does not exceed 3 months.
- The main course is scheduled to commence no later than one month after the pre-sessional course concludes.
For applicants who have demonstrated an English language proficiency of at least B2, as per ST 13.1, the CAS must confirm an unconditional offer for the main course.
If the applicant’s English proficiency is at least B1, according to ST 13.1, the CAS must ensure that the student sponsor is confident that the applicant will achieve a minimum of B2 proficiency by the end of the pre-sessional course.
Work Placement Requirements for Approved Qualifications
For a course incorporating a work placement, it must culminate in an accredited qualification. Additionally, the Confirmation of Acceptance for Studies (CAS) must be issued by a student sponsor, not a probationary sponsor.
The work placement should be evaluated as a core component of the course and should not exceed one-third of the course’s total duration, unless a statutory requirement dictates otherwise or ST 17.3 is applicable.
For degree-level or higher courses at reputable higher education providers or international institutions, the work placement must not extend beyond half of the course’s total duration. This ensures compliance with established guidelines and maintains the integrity of the educational program.
Maximum Study Duration Requirements
For applicants pursuing courses below degree level, permission to stay on the Student route cannot exceed a total of two years from the age of 18, unless specified in ST 19.2.
However, if the course below degree level mandates at least 12 months at sea under Maritime and Coastguard Agency regulations, the maximum duration on the Student route may extend to three years.
For degree-level courses, the maximum duration on the Student route cannot surpass five years from the age of 18, unless the course falls under the exceptions listed in ST 19.4.
The five-year cap does not apply to applicants with a Confirmation of Acceptance for Studies in the following fields:
- Architecture
- Medicine
- Dentistry
- Veterinary Medicine and Science
- Music, provided the institution is a member of Conservatoires UK
- Law, if the applicant has completed a degree-level course and is enrolling in:
-
- A law conversion course accredited by the Solicitors Regulation Authority and the Bar Standards Board in England and Wales
- A Masters in Law (MLaw) in Northern Ireland
An accelerated graduate LLB in Scotland
When calculating the duration of permission under ST 19.1 to ST 19.5, any extension of permission on the student route under section 3C of the Immigration Act 1971 will be included in the total period granted.
Additionally, if an applicant has previously been granted permission as a postgraduate doctor or dentist, their total permission duration cannot exceed three years for such studies.
When calculating the duration of permission under ST 19.1 to ST 19.5, any extension of permission on the student route under section 3C of the Immigration Act 1971 will be included in the total period granted.
Documentation Required for Obtaining a Course Offer
To secure an offer for a course of study from the student sponsor, the applicant must submit proof of the qualifications or references used for the offer. This requirement is waived if:
- The applicant is pursuing a degree-level course or higher and is sponsored by a higher education provider with a proven history of compliance, or
- The provisions of ST 22.1 apply.
Accepted evidence of qualifications includes:
- Certificates of qualification
- Academic transcripts
- Printouts of qualifications or transcripts from the awarding body’s online verification service
If the applicant submits a printout from the online verification service, the decision-maker may request the original certificate or transcript for verification.
Parental Consent Mandate
For applicants aged 16 or 17, written consent is required from:
- Both parents, or
- One parent, provided that parent holds sole legal responsibility for the applicant, or
- The applicant’s legal guardian.
This written consent must unequivocally endorse:
- The application itself;
- The applicant’s living and care arrangements within the UK; and
- If applying for entry clearance, the applicant’s travel and reception plans upon arriving in the UK.
Evidence Requirements for Financial Criteria and Document Submission
To meet the financial requirements for an application, certain evidence must be provided, but the documents used to secure an offer are not necessarily required with the application itself (though they might be requested by the decision maker). This stipulation applies if the applicant is applying from their country of residence or from within the UK. The applicant must meet one of the following criteria:
- Passport Requirements: The applicant must hold a valid passport that indicates their registration as a British National (Overseas) or was issued by the competent authorities of Hong Kong SAR, Macau SAR, or Taiwan. This includes providing the identification card number issued by the relevant authority in Taiwan.
Nationalities Accepted: The applicant must be a national of one of the following countries: Australia, Austria, Bahrain, Barbados, Belgium, Botswana, Brazil, Brunei, Bulgaria, Cambodia, Canada, Chile, China, Croatia, Republic of Cyprus, Czech Republic, Denmark, Dominican Republic, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Indonesia, Ireland, Italy, Japan, Kazakhstan, Kuwait, Latvia, Liechtenstein, Lithuania, Luxembourg, Malaysia, Malta, Mauritius, Mexico, Netherlands, New Zealand, Norway, Oman, Peru, Poland, Portugal, Qatar, Romania, Serbia, Singapore, Slovakia, Slovenia, South Korea, Spain, Sweden, Switzerland, Thailand, Tunisia, United Arab Emirates (UAE), United States of America (USA).
Study Conditions for International Students
International students must adhere to specific guidelines regarding their studies:
Authorized Study Provider: Students are required to study exclusively with the student sponsor who issued their Confirmation of Acceptance for Studies (CAS), unless one of the following conditions is met:
- The student is enrolled at a partner institution affiliated with their student sponsor.
- The student has applied for an extension of their stay under their current student status:
- Supported by a valid CAS from their student sponsor.
- The application is pending decision or an administrative review is in progress.
- The student will continue their studies with the same sponsor who issued the CAS.
Course Compliance: Students must undertake the course(s) specified in their CAS, including any combined pre-sessional courses, unless an exception under ST 27.3 applies.
New Course Enrollment: Students may commence a new course with their existing student sponsor if:
- The sponsor is a higher education provider with a proven compliance record.
- The student has not yet completed the course for which the CAS was issued.
- The new course is at least at the same qualification level as the original course.
- The new course is at degree level or higher, and can be completed within the current permission period.
- The student sponsor affirms that the new course is relevant to the original course or aligns with the student’s genuine career objectives.
Study Abroad Programs: Students may participate in a study abroad program that forms an integral and assessed component of the course listed on the CAS.
Supplementary Study: Additional study is permitted under these guidelines.
ATAS Condition: All study activities must comply with the ATAS condition outlined in Appendix ATAS.
State School Restrictions: Students are prohibited from studying at a State School or Academy, except for voluntary grammar schools with boarding in Northern Ireland. If the student’s sponsor becomes a State School or Academy during the permission period, the student may complete the course for which the CAS was issued.
Applicants will receive authorization for the entire length of their course as indicated in the Confirmation of Acceptance for Studies, along with the applicable additional periods. This authorization includes:
| Course Type | Permission Granted Before Course Start | Permission Granted After Course End |
|

Under the Doctorate Extension Scheme, permission to remain in the UK will be granted for a period of 12 months, commencing from the anticipated conclusion date of the course as indicated on the Confirmation of Acceptance for Studies (CAS).
