Compliance with Immigration Laws
Applicants must not be in breach of immigration laws. Exceptions apply where paragraph 39E allows periods of overstaying to be disregarded. The applicant must also not be on immigration bail.
Qualifying Period Requirement
Applicants must have spent a continuous five-year period in the UK under one or more of the following immigration routes:
- Skilled Worker
- Global Talent
- Innovator
- T2 Minister of Religion
- International Sportsperson
- Representative of an Overseas Business
- Tier 1 Migrant (except Graduate Entrepreneur)
- Scale-up
- Any other route during the time awaiting a decision on their International Sportsperson application, provided that the application:
- Was for permission to stay
- Was submitted between January 24, 2020, and June 30, 2021
- Was supported by a valid certificate of sponsorship from a licensed sponsor
- Was granted successfully
Continuous Residence Requirement
The applicant is required to fulfill the continuous residence criteria as detailed in Appendix Continuous Residence during the period of ISP 14.1. Compliance with these conditions is mandatory for successful application submission.

The applicant’s current sponsor must still hold Home Office approval to sponsor International Sportspersons on the decision date. The sponsor must verify that they continue to need the applicant’s services for the foreseeable future and that the applicant’s compensation meets the minimum annual salary threshold of £35,800.
Salary Conditions:
The required salary must:
- Consist of basic pay (excluding overtime);
- Include allowances only if they are part of the guaranteed salary package and applicable to a similarly positioned local settled worker;
- Exclude additional benefits, such as bonuses, incentive pay, pension contributions, and travel costs (including travel from the applicant’s home country);
- Exclude any shares received as part of an employee-owner scheme in exchange for UK employment rights;
- If the applicant works more than 48 hours per week, only the salary for the first 48 hours will count towards the £35,800 threshold;
- If the applicant is absent from work for reasons outlined in Part 9, paragraph 9.30.1, or recently returned from such absence, the sponsor’s confirmation of their salary upon return will be considered for the application.
