During the qualifying period, the applicant must fulfil the continuous residence criteria as specified in Appendix Continuous Residence of the immigration rules.
Suitability Requirements
The applicant must not be subject to refusal under Part 9: Grounds for Refusal. Additionally, if applying for permission to stay, the applicant must not be in breach of immigration laws, except in cases where paragraph 39E applies, in which case any period of overstaying will be disregarded. The applicant must also not be on immigration bail.
Relationship Requirement for BNO Adult Dependent Relative
The applicant must be the parent, grandparent, brother, sister, son, or daughter of an individual who:
- Has or last had permission as a BN(O) Status Holder, the partner of a BN(O) Status Holder, a BN(O) Household Member, or the partner of a BN(O) Household Member, and is currently being granted settlement under the Hong Kong BN(O) route; or
- Is settled in the UK, where the last grant of permission prior to settlement was as a BN(O) Status Holder, the partner of a BN(O) Status Holder, a BN(O) Household Member, or the partner of a BN(O) Household Member; or
- Is a British citizen.
English Language and Knowledge of Life in the UK Requirement
Unless exempt, the applicant must demonstrate proficiency in the English language, meeting at least level B1 in speaking and listening, as defined by the Common European Framework of Reference for Languages. This requirement is outlined in Appendix English Language.
Additionally, applicants aged 18 to 64 must also satisfy the Knowledge of Life in the UK requirement, as specified in Appendix KOL UK.
Absences From the UK for ILR as a BNO Adult Dependent Relative
To be eligible for Indefinite Leave to Remain (ILR) as a British National Overseas (BNO) adult dependent relative, you must adhere to the requirements of continuous residence. This means that during any given 12-month period within the 5-year qualifying period, your total absences from the United Kingdom cannot exceed 180 days.
