Eligibility Criteria for Switching to the BNO Household Member Dependant Visa
At Aden & Co Solicitors, we provide expert legal assistance for individuals seeking to switch into the BNO Household Member Dependant visa category from within the UK. Applicants must satisfy the following key requirements under the UK Immigration Rules:
Submission of a Valid Application
The application must be lawfully lodged in line with the criteria outlined in Appendix Hong Kong British National (Overseas) of the Immigration Rules. It is essential that all procedural standards for a valid application are met when applying from inside the UK.
Meeting Suitability Standards
The applicant must not fall under any of the general grounds for refusal as stated in Part 9 of the Immigration Rules. Furthermore, if applying for permission to stay:
- The applicant must not be in breach of UK immigration laws, unless protected under paragraph 39E, in which case limited periods of overstaying may be overlooked.
- The applicant must not be on immigration bail at the time of the application.
Ordinary Residence Requirement
Applicants seeking leave to remain under the BN(O) Household Member route must be physically present in the UK, the Bailiwick of Guernsey, Jersey, the Isle of Man, or Hong Kong on the date of application. They must also be ordinarily resident in one of these jurisdictions at that time.
Dependent Partner – Relationship Eligibility
For applicants applying for entry clearance as a dependent partner under the BN(O) Household Member route—without prior permission on this route—the relationship conditions set out in paragraphs HK 35.3 to HK 35.9 must be fulfilled.
The applicant must be the partner of a sponsoring BN(O) household member who either:
- Holds valid permission under the BN(O) Household Member route; or
- Is concurrently applying for, and granted, permission under the same route.
Both individuals must be 18 years or older at the time of the application.
If the couple is not legally married or in a civil partnership, the following conditions must be met:
- They must have lived together in a relationship akin to marriage or civil partnership for at least two years preceding the application;
- Any previous relationships must have ended permanently;
- The couple must not be closely related in a way that would prohibit marriage under UK law.
Moreover, the relationship must be genuine, enduring, and ongoing.
If the BN(O) household member is a child of a BN(O) Status Holder applying as a partner, both must form part of the same household at the time of application. This means the applicant must usually reside with the BN(O) household member.
Lastly, both the applicant and the BN(O) household member must intend to reside together throughout the applicant’s permitted stay in the UK.
BN(O) Household Child Visa – Relationship, Age, and Financial Requirements
At Aden & Co Solicitors, we specialise in assisting families with BN(O) Household Child visa applications, ensuring every requirement is met with precision and compliance.
Relationship Criteria for BN(O) Household Child
To qualify, the applicant must be the child of a sponsoring BN(O) Household Member who either:
- Currently holds valid permission under the BN(O) Household Member route; or
- Is simultaneously applying for, and granted, entry clearance or permission on the same route.
Where neither parent is a child of a BN(O) status holder, and the child is applying for the first time, they must be part of the same household as the sponsoring BN(O) Household Member on the date of application. This means they must ordinarily reside together.
If the child was born in the UK to a BN(O) Household Member or their partner, a full UK birth certificate showing both parents’ names is required.
Age and Care Requirement
Applicants must be under 18 at the time of submission. They must intend to live with a parent holding permission under the BN(O) Household Member route, unless a compelling reason exists not to. Suitable care and accommodation must be arranged in compliance with UK child welfare laws.
Financial Requirement for Dependent Children
If the child is switching into the BN(O) Household Member Dependant Visa and has been in the UK for less than 12 months—or previously held 12 months of Leave Outside the Rules—the sponsor must demonstrate they can provide adequate maintenance and housing for at least six months without accessing public funds.
Accommodation will be deemed unsuitable if:
- It is overcrowded; or
- It breaches UK public health standards.
Financial evidence may include credible third-party support, but must comply with the funding thresholds outlined in Appendix Finance.
UK In-Country Tuberculosis (TB) Certificate Requirement – Guidance by Aden & Co Solicitors
Applicants seeking to extend their stay in the UK may be required to submit a valid tuberculosis (TB) screening certificate if specific criteria apply. If the applicant’s previous grant of leave was for six months or less and they were residing in a country listed under Appendix T for over six months immediately before that grant, a medical certificate is mandatory.
This certificate must confirm that the applicant is free from active pulmonary TB and must be issued by a UK Home Office-approved clinic within six months before the date of application. If a valid TB certificate was already submitted as part of a successful entry clearance application within the last 12 months, it will satisfy the current requirement.

All successful applicants will be subject to the following conditions:
- No entitlement to public funds
