Eligibility Criteria for Switching to a BNO Adult Dependent Relative Visa (UK)
At Aden & Co Solicitors, we provide expert legal support for clients seeking to switch into the BNO Adult Dependent Relative Visa from within the UK. Applicants must satisfy the following criteria outlined under the Immigration Rules:
Valid Application Submission
To switch into this visa category, you must lodge a valid application in accordance with the provisions stated in Appendix Hong Kong British National (Overseas) of the UK Immigration Rules.
Suitability Requirements
Applicants must meet general suitability criteria and should not be refused under Part 9: Grounds for Refusal.
Specifically, you must not be:
- In breach of UK immigration laws (unless overstaying is covered under paragraph 39E); or
- On immigration bail at the time of applying.
Ordinary Residence Requirement
Applicants must be physically present in the UK, the Isle of Man, the Bailiwick of Jersey, the Bailiwick of Guernsey, or Hong Kong and considered ordinarily resident in one of these jurisdictions on the date their application is submitted.
Family Relationship Requirement
If the applicant has not previously held leave under the BN(O) route, they must be an immediate family member—such as a parent, grandparent, sibling, son, or daughter—of a person making a valid, concurrent application under one of the following categories:
- A BN(O) Status Holder, applying via the BN(O) Status Holder route
- The partner of a BN(O) Status Holder, applying on the same route
- The child of a BN(O) Status Holder, applying under the BN(O) Household Member route
- The partner of a child of a BN(O) Status Holder, applying on the Household Member route
For applicants applying as a parent or grandparent of the BN(O) Status Holder or their partner or child, it is essential they are not in a subsisting relationship with another partner—unless that partner:
- Is also the parent or grandparent of the BN(O) Status Holder, their partner, or their child, and
- Is applying at the same time for entry clearance or permission to stay under the relevant BN(O) route
BN(O) Visa – Dependent Eligibility Requirements | Aden & Co Solicitors
When applying for entry clearance or further leave to remain under the Hong Kong BN(O) route, certain dependency criteria must be met—particularly for applicants who have not previously held BN(O) visa status.
To qualify as a dependent, the applicant must:
- Require continuous personal care for day-to-day living due to age, disability, or serious medical conditions;
- Be a member of the same household as the BN(O) Status Holder or BN(O) Household Member who is either already in the UK or applying simultaneously; and
- Be unable to access the necessary care support in Hong Kong, even with practical or financial assistance from the BN(O) sponsor or their partner, because such support is either:
- Unavailable and no suitable alternative care provider is present in Hong Kong; or
- Financially inaccessible.
In cases where the applicant (or their partner) is the parent or grandparent of the BN(O) Status Holder or their partner, or of a BN(O) Household Member or their partner, they must similarly:
- Require long-term assistance for daily activities due to health issues, age, or disability; and
- Be unable to secure the necessary level of support in Hong Kong despite help from their sponsoring family member—either because adequate care is unavailable, or it is unaffordable.
Financial Maintenance Requirement
When a BN(O) Adult Dependent Relative is applying for entry clearance, or for further leave to remain in the UK after residing for less than 12 months—or following a prior grant of Leave Outside the Rules (LOTR) after an unsuccessful BN(O) visa application—the Home Office must be satisfied that the BN(O) Status Holder, their partner, or a BN(O) Household Member (or their partner) can and will provide adequate maintenance and accommodation in the UK without access to public funds for a minimum of six months.
Accommodation must meet legal standards. It will not be deemed adequate if:
- It is or will become overcrowded, or
- It violates public health regulations.
Applicants may rely on credible third-party assurances for future financial support. However, the primary sponsor must still demonstrate access to sufficient financial resources as outlined in Appendix Finance of the Immigration Rules.
Tuberculosis (TB) Screening Requirement – In-Country Applications
If the applicant:
- Previously held a visa valid for six months or less, and
- Had spent more than six months in a country listed in Appendix T prior to their last UK visa grant,
They must submit a valid TB screening certificate, issued by an approved clinic, confirming the absence of active pulmonary tuberculosis. This certificate must be dated within six months of the application date.
Applicants who have already submitted a valid TB certificate as part of a successful entry clearance application within the last 12 months are considered to have met this requirement.

Duration and Conditions of Leave for BN(O) Dependent Applicants
If an applicant does not already hold permission under the Hong Kong British National (Overseas) visa route at the time of applying, their leave will be granted to align with the expiry date of the BN(O) Status Holder or BN(O) Household Member with whom they reside—whichever is applicable based on the applicant’s relationship within the household.
The visa grant is subject to the following conditions:
- No recourse to public funds;
- Permission to work, including self-employment and voluntary roles, except as a professional sportsperson (including roles as a sports coach);
- Permission to study, subject to compliance with the ATAS requirement outlined in Appendix ATAS.
