Changes to Appendix Electronic Travel Authorisation (ETA)
Electronic Travel Authorisations (ETAs) are essential in meeting the global “permission to travel” requirement. Generally, all Non-Visa Nationals (NVN), including EEA nationals, who do not need a visa, entry clearance, or immigration status prior to their short-term stay (up to six months) in the UK, are required to apply for and secure an ETA before departure. This also applies to individuals entering the UK under the Temporary Work – Creative Worker category.
The Appendix on Electronic Travel Authorisation outlines the specific provisions governing ETA. On 25 October 2023, Qatar nationals became the first group eligible to apply for an ETA. The programme expanded on 1 February to include nationals from Bahrain, Kuwait, Oman, Saudi Arabia, the UAE, and Jordan. Additional non-visa nationals will be included in 2024.
As the implementation of the ETA policy continues, several adjustments have been proposed to better align with the original intentions of the policy. Key updates include a precise definition of “overstay,” which will now be consistent with current visitor policies, clarification that an ETA is directly tied to the passport used in the application, and provisions for the cancellation of an ETA if the validity criteria (outlined in ETA 1.1 and ETA 1.2) are not met at the time of application or after issuance.
Furthermore, changes will include exemptions for British Overseas Territories Citizens, relieving them from the ETA requirement. To navigate these changes efficiently, Aden & Co Solicitors can provide expert guidance on all aspects of ETA applications and related immigration services.
