Changes To ILR 10 Years Long Residence Route
The Appendix Long Residence has replaced the former guidelines outlined in Part 7 (rules 276A-276D) of the UK Immigration Rules. In this revised policy, applicants seeking settlement must hold current permission for a minimum of one year (or have been exempt from immigration control within the preceding 12 months before their application). This update aligns the Long Residence requirements with broader settlement criteria.
The Appendix Long Residence also brings adjustments to streamline the conditions for temporary stay permissions under this route. Furthermore, the UK Home Office UKVI has introduced modifications to Appendix Continuous Residence, impacting applicants in the following ways:
- Channel Islands & Isle of Man Exclusions: Time spent in the Channel Islands or Isle of Man no longer counts towards the Long Residence period.
- Continuous Residence Clarifications: Applicants who, on or after 24 November 2016, exited and re-entered the UK with valid permission (even if through a different route) will not disrupt their continuous residence, provided they did not exceed 180 days’ absence within any 12-month period. For absences taken before 11 April 2024, this threshold extends to 184 days under a transitional arrangement.
- Removal and Expulsion Implications: Continuous residence is considered broken if the applicant has received removal directions under section 10 of the Immigration and Asylum Act 1999 or if they were deported, removed, or exited the UK after their permission expired without being granted a new one.
