Changes To Skilled Worker Visa Immigration Rules
As of April 4, 2024, significant amendments to the Skilled Worker Visa pathway have come into effect. Employers now have to compensate sponsored skilled workers with salaries that meet either the general salary threshold or the occupation-specific going rate, opting for whichever is higher. The general salary threshold has been raised from £26,200 to £38,700, reflecting the median UK earnings across qualifying occupations, as per the latest Office for National Statistics (ONS) data.
Transitional Provisions for Current Skilled Workers
To ease the transition, current skilled workers already within the Skilled Worker Visa pathway before April 4, 2024, will benefit from transitional provisions. For those renewing their visa, changing employers, or applying for Indefinite Leave to Remain (ILR) as skilled workers prior to April 4, 2030, the applicable salary threshold is set at £29,000. This provision aims to accommodate individuals adapting to the new framework without immediate impact.
Replacement of Shortage Occupation List with New Immigration Salary List
In place of the Shortage Occupation List, the government has introduced a new Immigration Salary List, which clarifies discounted salary thresholds. Occupations on this list receive a 20% reduction from the general salary threshold (down to £30,960 or £23,200, depending on whether they would typically fall under the £38,700 or £29,000 threshold). However, unlike the prior scheme, this discount no longer applies to the going rate requirement. This update refines the immigration salary framework, ensuring greater clarity and alignment with current UK labor market needs.
Reduced Salary Criteria for Ph.D. Holders and Market New Entrants
Starting April 4, 2024, the updated UK immigration policies continue to support reduced salary thresholds for skilled workers, specifically for those with:
- Relevant Ph.D. qualifications,
- “New entrants” joining the workforce, and
- Positions under national pay scale standards.
Expanded Opportunities for Supplementary Employment
Skilled Workers now enjoy expanded options for supplementary employment, as all roles qualifying under the Skilled Worker Visa are now accessible for secondary employment, providing more career flexibility.
Transition to SOC 2020 Classification System
Effective April 4, 2024, the immigration system has updated its Standard Occupational Classification (SOC) from SOC 2010 to SOC 2020. The Office for National Statistics, which develops these codes, will now release data exclusively for SOC 2020, aligning with the latest employment standards.
