- If the applicant’s actions after 11:00 PM on 31 December 2020 are in question, the refusal criteria outlined in Section 1 of Part 9 of these rules or ECAA 2.2 may apply.
Furthermore, when applying for permission to stay based on actions after 11:00 PM on 31 December 2020, applicants must ensure they are not:
- In violation of immigration laws, with the exception of overstaying where paragraph 39E applies, which will disregard that period of overstay.
- Currently under immigration bail.
