These amendments aim to establish clearer and more consistent guidelines for the adoption process, ensuring a smoother transition for both children and adoptive parents.
Key Changes Include:
- Streamlined Eligibility Requirements:
The immigration eligibility criteria for both the Hague Convention and Recognised Overseas Adoption routes have been simplified. Notably, the following conditions have been removed:
The need for the child to share the same rights and obligations as a biological child in the marriage or civil partnership.
The requirement for adoption due to the original carer’s inability to care for the child.
The expectation of a genuine transfer of parental responsibility.
The stipulation that the child must have severed or lost ties with their biological family.
- These criteria are no longer necessary as they are already considered during the formal adoption process.
- Financial Requirements for Settling Parents:
If one parent is already on a route to settlement, the child must now meet the financial requirements of that specific settlement route. - Application of Appendix Children’s Provisions:
The updated rules also incorporate the cross-cutting requirements outlined in Appendix Children, providing greater clarity and consistency in the adoption process. - Settling After Temporary Permission:
If a child enters the UK under Appendix Adoption and receives temporary permission (either for the adoption to be completed in the UK or because the parent holds temporary permission on a route to settlement), the child will be able to settle on the same route once the adoption is finalized and the parent has achieved settlement. These provisions have been incorporated into Appendix Children and paragraph 298 in Part 8.
