Valid Confirmation of Acceptance for Studies (CAS)
To successfully switch to a Student Visa, a valid Confirmation of Acceptance for Studies (CAS) is essential. According to UK Immigration Rules, the following criteria must be met for a CAS to remain valid:
- The CAS must be issued by a licensed student sponsor whose license is still valid at the time of the decision on the application.
- It must be issued no more than 6 months prior to the application date by the student sponsor.
- The CAS should not have been used in a previous application that was either granted or refused (it can only be used in cases where a previous application was rejected as invalid, void, or withdrawn).
- The offer should not be withdrawn by the sponsor after the issuance of the CAS.
- The CAS must include the following details to verify eligibility:
- Course requirements
- Approved qualification
- Level and place of study
- It must state the cost of accommodation, fees, and any payments made, to assess financial requirements.
- The CAS should confirm how the English language requirement has been met, including ST 13.3 and ST 13.4 details if the sponsor assessed language ability.
- Additionally, the sponsor must provide the following information about the course of study:
- Course title,
- Title of the course and its academic level.
- Start and end dates of the program.
- Weekly study hours, specifying if the course is full-time or part-time.
- The address of the primary study location.
- The fees for both tuition and accommodation.
- If the student sponsor has assessed the applicant using references, these must be included in the Confirmation of Acceptance for Studies (CAS).
- For courses with a work placement, full details of the placement should be provided.
- If a partner institution is involved, details of this institution must be listed.
- For programs requiring ATAS clearance, confirmation should be included.
- Confirmation of whether the course qualifies as a Foundation Programme for postgraduate medical or dental training, including relevant certificates.
- A statement explaining how the applicant’s English language proficiency was assessed, with test scores in reading, writing, speaking, and listening where applicable.
- For study abroad programs, include the partner institution’s name and address.
- If the applicant is applying for a Student Union Sabbatical Officer position, provide evidence of their eligibility, including whether they are midway through their studies or are recently graduated.
- If applying for the Doctorate Extension Scheme, confirmation that the application was made within 60 days of the PhD program’s expected end date and that the sponsoring institution meets the required compliance standards.
- Confirmation of academic progress if the applicant has previously been granted student permission, as per the regulations outlined in ST 14.1 to ST 14.5.
Study Course Eligibility Requirements: Aden & Co Solicitors
Applicants seeking a Student Visa must meet specific criteria for their course of study. Here’s a detailed breakdown of the requirements:
Single Course Requirement: The application should be for a single course that complies with ST 8.2, unless it falls under the following exceptions:
-
- A combined pre-sessional course meeting conditions outlined in ST 15.1 to ST 15.3.
- A full-time, salaried position as a Student Union Sabbatical Officer, either during ongoing studies or in the academic year immediately after graduation.
- The Doctorate Extension Scheme, provided the applicant’s Confirmation of Acceptance for Studies (CAS) is issued by a compliant higher education provider within 60 days of the PhD course’s expected end date.
Eligible Course Types:
-
- A full-time course at degree level or higher leading to an approved qualification.
- A full-time course below degree level requiring at least 15 hours of organised daytime study (between 08:00 and 18:00, Monday to Friday), leading to an approved qualification.
- A full-time pre-sessional course involving a minimum of 15 hours of organised daytime study.
- A part-time course above degree level leading to an approved qualification, where the CAS is issued by a compliant higher education provider.
- A full-time degree-level or higher course equivalent to a UK higher education qualification, with CAS issued by a foreign higher education institution or a compliant UK provider.
Specific Course Conditions: For those pursuing an Association of Certified Chartered Accountants (ACCA) qualification or Foundations in Accountancy, the sponsor must be an ACCA-approved learning partner at either Gold or Platinum level.
ATAS Certificate Requirement: If the Academic Technology Approval Scheme (ATAS) applies to the course, applicants must obtain a valid ATAS certificate and include it with their visa application.
Approved Qualification Criteria
To meet the approved qualification requirement, your course of study must lead to an accredited qualification, unless it is a pre-sessional course. The qualification must satisfy one of the following criteria:
- Royal Charter Validation: The course is validated by Royal Charter.
- UK-Recognised Awarding Body: The qualification is awarded by a UK-recognised institution.
- Legal Agreement with UK Body: The qualification is covered by a legal agreement between a UK-recognised body and another educational or awarding institution. This agreement must:
- Confirm the UK-recognised body’s independent evaluation of the program’s level relative to the Regulated Qualifications Framework (RQF) or its equivalents.
- Ensure that the UK-recognised body would admit students who successfully complete the course to a range of degree-level programs it offers.
- Formal Articulation Agreement: The qualification is recognized through a formal articulation agreement with the awarding body.
- RQF Level 3 or Above: In England, Wales, and Northern Ireland, the qualification is at RQF level 3 or higher.

Level of Study Requirements for International Students
For courses sponsored by a probationary sponsor, the Confirmation of Acceptance for Studies (CAS) must adhere to the following criteria:
- If the course is based in England, Wales, or Northern Ireland, and the applicant is under 18, it must be at Regulated Qualifications Framework (RQF) Level 3 or higher.
- If the course is in England, Wales, or Northern Ireland, and the applicant is 18 or older, it must be at RQF Level 4 or above.

- The course, if based in England, Wales, or Northern Ireland, must be at RQF Level 3 or higher.
- If the course is in Scotland, it must be at SCQF Level 6 or higher.
- The course may be a short-term study abroad programme in the UK as part of an overseas higher education qualification, which must be recognized by UK NARIC as equivalent to a UK bachelor’s degree or higher.
- The course can also be a pre-sessional English language programme at B2 level or higher of the Common European Framework of Reference for Languages (CEFR).
- Additionally, it can be a recognized Foundation Programme for postgraduate doctors or dentists.
- Finally, it can be a course delivered in partnership between a higher education institution and a research institute, accredited at RQF Level 7 or higher, or at SCQF Level 11 or above.
Place of Study Requirements
To comply with the study location regulations, all educational activities that are integral to the course must be conducted on the premises of the student’s sponsor or a designated partner institution. Exceptions to this rule apply if the student is engaged in a course-related work placement, participating in a study abroad program, or enrolled in a pre-sessional course.
Financial Requirements
For Applicants Switching to a Student Visa from Within the UK:
12 Months or More Residency: If the applicant has resided in the UK with valid permission for 12 months or longer by the date of application, they will satisfy the financial requirements and are not required to provide proof of funds.
Student Union Sabbatical Officer or Recognized Foundation Programme: Applicants applying as a Student Union Sabbatical Officer or for a recognized foundation programme as a doctor or dentist in training are also exempt from showing financial evidence.
Less than 12 Months Residency: Applicants who have been in the UK for less than 12 months must demonstrate the following financial resources:

| Type of Study | Funds Required |
|
Residential Independent School |
Must have sufficient funds to cover outstanding fees (both course and boarding fees) for one academic year. |

Additional Notes:
- If the applicant’s course spans a partial month, the duration will be rounded up to the nearest full month.
- Deposits paid for accommodation provided by the student sponsor can be deducted from the required funds, up to a maximum of £1,334.
- Any advance payments made towards course fees must be confirmed either in the Confirmation of Acceptance for Studies or through a receipt issued by the student sponsor.
- Unless relying on a student loan or government/international sponsorship, the applicant must demonstrate that they have maintained the required financial level for a 28-day period as detailed in Appendix Finance, FIN 7.1 to FIN 7.3.
Applicants must comply with the financial requirements as specified in Appendix Finance, unless an exception under ST 22.1 applies.
English Language Proficiency Requirements
Applicants must demonstrate proficiency in English according to the Common European Framework of Reference for Languages (CEFR) across all four skills—reading, writing, speaking, and listening—at the following levels:
- Level B2: Required for those enrolled in a UK bachelor’s degree program or higher.
- Level B1: Required for individuals studying a pre-sessional course or a course below the level of a UK bachelor’s degree.
Applicants should verify their compliance with these English language requirements as detailed in Appendix English Language.
- If the student’s sponsor has verified that the applicant meets the English language requirements, this must be indicated on the Confirmation of Acceptance for Studies, along with the assessment method used.
- For cases where a Secure English Language Test is necessary, the Confirmation of Acceptance for Studies must include the test provider’s name, the unique reference number for the test, and the scores for each component tested (reading, writing, listening, speaking).
Combined Pre-sessional Course Requirement
A higher education institution with a proven compliance history may issue a single Confirmation of Acceptance for Studies (CAS) covering both a combined pre-sessional course and a main degree-level course if:
- The duration of the pre-sessional course does not exceed three months.
- The main course commences no later than one month after the pre-sessional course concludes.
For applicants who have demonstrated at least a B2 level of English proficiency as per ST 13.1, the CAS must confirm an unconditional offer for the main course.
For those assessed at a minimum of B1 level according to ST 13.1, the CAS must verify that the student sponsor is confident the applicant will achieve at least a B2 level by the end of the pre-sessional course.
Work Placement Requirement
To qualify for a course that incorporates a work placement, the program must culminate in an accredited qualification, and the Confirmation of Acceptance for Studies (CAS) must be issued by a recognized student sponsor, excluding probationary sponsors.
The work placement must be evaluated as a fundamental component of the course, and its duration should not exceed one-third of the total course length, unless mandated by statutory requirements or specific provisions such as ST 17.3.
For degree-level or higher courses offered by established higher education institutions, whether domestic or international, the work placement should not extend beyond half of the total course duration.
Work placement, approved qualification, Confirmation of Acceptance for Studies, student sponsor, accredited course, degree-level, higher education institution, Aden & Co Solicitors.
Maximum Study Duration Requirements
For courses below degree level, an applicant should not be granted more than two years on the Student route to study such courses beyond the age of 18, unless specified by ST 19.2.
If the course, though below degree level, requires a minimum of 12 months at sea as mandated by the Maritime and Coastguard Agency, the applicant’s total permission should not exceed three years on the Student route from the age of 18.
For degree-level courses, the permission granted should not surpass five years on the Student route from the age of 18, except for courses listed under ST 19.4. The five-year limit does not apply for degree-level studies in the following fields, provided the Confirmation of Acceptance for Studies is issued by Aden & Co Solicitors:
- Architecture
- Medicine
- Dentistry
- Veterinary Medicine and Science
- Music at a Conservatoires UK member institution
- Law, where the applicant is pursuing:
- A law conversion course approved by the Solicitors Regulation Authority and the Bar Standards Board in England and Wales
- Masters in Law (MLaw) in Northern Ireland
- Accelerated graduate LLB in Scotland
If the applicant has previously received permission as a postgraduate doctor or dentist, the total duration of permission as a postgraduate doctor or dentist should not exceed three years.
When calculating permission periods under ST 19.1. to ST 19.5, any period of extended permission on the Student route under section 3C of the Immigration Act 1971 will be included in the total permitted duration.
Documentation Required for Securing an Offer
To secure an offer for a study program, applicants must submit proof of their qualifications or references utilized to receive the offer from their student sponsor. This requirement is waived if:
- The applicant is seeking admission to a degree-level course or higher and is sponsored by a higher education institution with a proven history of regulatory compliance; or
- ST 22.1 applies.
Acceptable forms of evidence for each qualification include:
- The official certificate(s) of qualification
- The academic transcript of results
- A printout of the qualification or transcript from the awarding body’s online verification service
If an applicant provides a printout of their qualifications or transcript from the awarding body’s online service, the decision-maker may request the official certificate of qualification or transcript of results from the applicant.
Parental Consent Requirement for Applicants Aged 16 or 17
For applicants who are 16 or 17 years old, written consent is mandatory from:
- Both parents; or
- One parent, provided that parent holds sole legal responsibility for the applicant; or
- The applicant’s legal guardian.
This written consent must explicitly endorse:
- The application itself;
- The applicant’s accommodation and care arrangements within the UK; and
- If the application pertains to entry clearance, the applicant’s travel and reception plans upon arrival in the UK.
Differential Evidence Requirements for Visa Applications
For visa applications, the submission of evidence demonstrating that the applicant meets financial requirements and documentation used to secure an offer may not be required at the time of application. However, this documentation might be requested by the decision-maker later. This flexibility applies if the applicant is applying from their country of residence or from within the UK and meets one of the following criteria:
- The applicant holds a valid passport indicating registration as a British National (Overseas) or issued by the competent authorities of Hong Kong SAR, Macau SAR, or Taiwan (including the identification card number issued by Taiwan’s authorities).
