Overview
If the Home Office has refused an asylum application and appeals against that decision have also been rejected by the Immigration Tribunals then an applicant can make a fresh asylum and / or human rights claim under Rule 353 of the Immigration Rules.
Fresh claims must be made by attending the Home Office’s Further Submissions Unit in Liverpool and submitting further submissions and further evidence.
When making a fresh asylum and / or human rights claims the applicant needs to show that their further submissions and fresh evidence are significantly different from the materils previously considered by the Home Office and / or the the Immigration Tribunals. The applicant also needs to establish that their further submissions and fresh evidence, when taken together with the materials previously considered, creates realistic prospects of success.
Examples of fresh evidence
What fresh evidence you can submit in support of a fresh claim depends on the particular facts of each case. Some Examples of fresh evidence are as follows:
- Expert reports, if these were not submitted in your initial asylum application and appeal
- Documents verification reports, if these were not submitted in your initial asylum application and appeal
- Medical Report(s), if applicable and if these were not submitted in your initial asylum application and appeal
- Witness statements from any relatives or friends who have been granted refugee status in the UK, if these were not submitted in your initial asylum application and appeal
- Documents from back home showing that you are still at risk, if these were not submitted in your initial asylum application and appeal
- Country information showing that situation has deteriorated in your country after your initial asylum application and appeal were refused.
Challenging a fresh claim decision
If the Home Office concludes that your further submissions and evidence do not amount to a fresh claim and rejects your fresh claim there will often be no right of appeal and the applicant will have to challenge the decision by making an application for Judicial Review to the Upper Tribunal.
The higher courts have held that in order to assess as to whether the Home Office has exercised their discretion properly or whether they have acted unlawfully in refusing further submissions it is necessary to consider the strength of the fresh claim and whether the applicant has reasonable prospects of success before the First Tier Tribunal.
Issues to be determined in relation to fresh claim
In a Judicial Review application made against a refusal of a fresh claim the Court will consider whether the applicant has a reasonable prospect of success in showing to the judge deciding the judicial review that the decision of the Home Office refusing afresh claim is unreasonable? In reaching that decision, is there a reasonable prospect of the judge hearing the judicial review application deciding that the applicant’s new asylum claim, as it now stands, has a reasonable prospect of success before an Immigration Judge hearing an appeal from an adverse decision of the Home Office.
